Terms of Service

1. Agreement to Terms

By engaging KJ Web Design for services or accessing this website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

KJ Web Design provides website design, development, and management services. The specific scope, deliverables, and pricing for each project are outlined in a separate project agreement or proposal provided to the client before work begins.

3. Client Responsibilities

To ensure timely delivery, clients agree to:

• Provide all necessary content, assets, and information in a timely manner
• Designate a single point of contact for project communication
• Review and approve deliverables within agreed-upon timeframes
• Ensure all content provided is owned by or licensed to the client

4. Payment Terms

Payment terms are specified in each project agreement. A deposit may be required before work begins. Final payment is due upon project completion and before the website goes live or files are transferred. Late payments may result in work being paused.

5. Project Timeline

Project timelines are agreed upon between KJ Web Design and the client prior to work beginning and will be outlined in the project agreement. Timelines may vary based on project scope, complexity, and the timely provision of required content and materials by the client. Delays caused by late or incomplete content from the client may extend the agreed timeline.

6. Intellectual Property

Upon receipt of full payment, the client owns the completed website design and all custom content created specifically for the project. KJ Web Design retains the right to display the completed project in our portfolio and marketing materials unless otherwise agreed in writing.

7. Managed Services

For ongoing managed service agreements, either party may terminate the agreement with 30 days written notice. KJ Web Design is not liable for website downtime caused by third-party hosting providers, domain registrars, or factors outside our reasonable control.

8. Limitation of Liability

KJ Web Design shall not be liable for any indirect, incidental, or consequential damages arising from use of a completed website or any delay in delivery. Our total liability for any claim shall not exceed the total fees paid for the specific project in question.

9. Revisions & Changes

Each project includes a defined number of revision rounds as specified in the project agreement. Additional revisions or scope changes beyond the agreed-upon scope may incur additional charges, which will be communicated to the client before work proceeds.

10. Governing Law

These Terms of Service are governed by the laws of the United States of America. Any disputes arising from these terms or the services provided shall be resolved through binding arbitration or in a court of competent jurisdiction.
